Terms of Service

Plain-language terms for the two sides of Poachd: the tradespeople who list their capability, and the contractors who hire them.

Agreement

These terms are between you and Poachd. By creating an account you accept them. If you are signing up for a business, you confirm you are authorised to bind that business.

Accounts

  • You must be 18 or over and provide accurate information.
  • One account per person. Keep your sign-in secure and tell us if it is compromised.
  • We may suspend accounts that misrepresent qualifications, spam users or abuse the platform.

What Poachd is and is not

Poachd is a matching and workforce intelligence platform. We are not the employer of any tradesperson, we are not a party to your engagement, and we do not supervise work on site. The contractor and the worker are responsible for the employment or contracting arrangement, pay, insurance, superannuation or benefits, site inductions, safety and statutory compliance.

Poachd creates the introduction. Poachd does not employ, on-hire, pay, roster, direct, supervise or discipline any tradesperson, and does not process pay between the two sides. Remuneration is agreed and paid directly between the contractor and the tradesperson under the contractor's own agreement.

Contractor undertakings

By publishing a role or engaging anyone introduced through Poachd, the contractor confirms that it, and not Poachd, is the engaging party and that it will:

  • engage the tradesperson directly under its own employment or contracting agreement;
  • determine the correct classification of the engagement on the whole of the relationship, and apply the applicable industrial instrument, minimum entitlements, superannuation and leave;
  • verify licences, tickets and any high-voltage or switching endorsement with the relevant issuing authority, and verify work rights, before the person starts licensed work;
  • hold and discharge workplace health and safety duties for the site and the work, including inductions, supervision and permits, and hold current workers compensation and liability cover;
  • not use discriminatory selection criteria or publish discriminatory role briefs.

The contractor indemnifies Poachd against claims arising from its own engagement of a tradesperson, to the extent the claim is not caused by Poachd. See Australian hiring compliance for how responsibility is allocated.

Verification

We check the licences and tickets uploaded to Poachd against the documents provided and mark a profile accordingly. Verification is a good-faith review of the documents we are given - it is not a licence check with an issuing authority, a police check or a guarantee of competence. Contractors must still run their own pre-start checks before putting anyone on the tools.

Free for tradespeople

Tradespeople never pay to build a profile, be discovered, match or message. We do not deduct anything from your pay.

Fees are charged to the engaging business only. Poachd does not charge a person for access to work, directly or indirectly, consistent with Australian fair trading law and the international principle that job seekers are not charged placement fees.

Contractor fees and fee schedule

Access to Poachd is free and does not require a subscription. Contractors pay only when capability is mobilised. This section is the fee schedule you accept when you complete contractor onboarding and save a payment method.

  • Mobilisation fee. Charged per engagement and sized against the value of the work, using the per-hour fee bands shown in the app at the time the placement is logged. Nothing is charged for searching, briefing, matching or messaging.
  • Staged micro-charges. A mobilisation fee is billed in stages - a portion when the person starts, a weekly accrual from approved timesheets while they are engaged, and retention milestones - rather than as a single upfront invoice.
  • Fee decay and cap. The per-hour fee reduces in bands the longer an engagement runs, and stops accruing once the engagement ends or the billing cap for that placement is reached. Long engagements are never billed indefinitely at the opening rate.
  • Per-week minimum. While someone is on the tools, an engagement is billed at no less than the per-week minimum shown with the fee bands. Very short or very low-value engagements are billed at the stated minimum fee.
  • Account minimum. Accounts on a mobilisation tier are reconciled monthly against the tier's monthly minimum after a grace period following the first placement. If mobilisation fees for the period fall below the minimum, only the shortfall is invoiced. No minimum applies before your first placement.
  • Replacement guarantee (optional). Where the guarantee is taken on a placement, a premium is added to the fee and, if the placement fails inside the guarantee window for a reason within scope, the replacement mobilisation is not charged again. The guarantee is not a refund of fees already accrued.
  • Priority invite packs. Optional one-off purchases, charged when bought and non-refundable once used.

Payment method, mandate and authority to charge

Before capability can be mobilised, a contractor must accept the contractor agreement and save a valid payment method. Card details are held by our payment provider (Stripe) - Poachd never stores your full card number.

  • By saving a payment method you authorise Poachd to charge that method, without further action from you (off-session), for fees that become billable under the fee schedule above.
  • Fees become billable when both sides confirm a placement, when a timesheet is approved, or when a retention milestone is reached. Charges are raised automatically at that point and a receipt is emailed to the account billing contact.
  • If a charge fails we will notify you and retry. Access to matching and mobilisation may be paused while an account is overdue, and we may recover reasonable collection costs.
  • You must keep a current payment method on file for as long as you have an active engagement sourced through Poachd. Removing the mandate does not cancel fees already accrued.
  • Disputes about a charge must be raised with us within 30 days of the receipt date. We will hold the disputed amount while we review it rather than continue to retry.
  • Fees are stated in USD unless another currency is shown at checkout, and are exclusive of taxes unless shown otherwise. Taxes are calculated and collected at checkout where applicable.

Nothing in this section applies to tradespeople. No fee, deduction or payment obligation is ever charged to a person for access to work.

Circumvention

Contractors agree to log placements that originate from a Poachd match, and not to route those hires off-platform to avoid fees. Where we can show a hire came from a Poachd introduction within 12 months of the match, the applicable fee still applies.

Restraints and existing obligations

Listing capability on Poachd is not work for another business. If you are under a non-compete, non-solicit, confidentiality, notice or repayment obligation, that obligation sits between you and the other party to it - Poachd is not a party and cannot waive or interpret it. You are responsible for reading your own agreement and getting your own advice before accepting an engagement.

You must not use Poachd to induce a breach of anyone's contract. That includes soliciting an intact team away from a competitor in breach of their obligations, and bringing or requesting confidential information, pricing, drawings or client lists from a current or former employer. Contractors confirm they have asked about restraints, notice periods and repayment obligations before an engagement starts, and that they will respect notice periods.

Acceptable use

  • No false credentials, fake roles or misleading rates.
  • No discrimination, harassment or abusive messaging.
  • No scraping, reselling or bulk export of profiles or market data.
  • No attempts to bypass access controls or interfere with the service.

Your content

You keep ownership of what you upload. You give us the licence we need to host it, show it to the other side of a match, and use aggregated, de-identified data for market intelligence. You confirm you have the right to upload anything you provide.

Availability and liability

We work to keep Poachd available but provide it "as is" and do not warrant uninterrupted service or any hiring outcome. To the extent permitted by law, our liability to you is limited to the fees you paid us in the three months before the claim. Nothing in these terms excludes rights that cannot be excluded under applicable consumer law.

Ending your account

You can close your account at any time. We may suspend or end access for breach of these terms. Fees already accrued on confirmed placements survive termination.

Ending or suspending an account ends access to a commercial matching service only. It has no effect on any engagement, employment or contract you hold with a contractor - those are governed by that agreement. We will give a reason for withdrawing access and a path to have it reviewed by a person.
